Elon Musk's xAI Sues Minnesota Over AI Deepfake Legislation

Elon Musk's artificial intelligence venture, xAI, has recently made headlines by initiating legal action against the state of Minnesota concerning a newly enacted law that prohibits the use of AI technologies for generating fake nude images of individuals without their consent. This legal challenge, reported by MPR News, stems from xAI's assertion that the legislation infringes upon free speech rights and could hinder users from producing content that is both harmless and artistic in nature. The lawsuit arrives just days prior to the law's implementation, prompting a sharp rebuke from Minnesota Governor Tim Walz, who took to social media platform X to label Musk a 'creep.' In his post, Walz stated, 'See you in court, creep.' This law, recently passed in Minnesota, aims to outlaw the use, promotion, and distribution of AI-driven 'nudification' technologies, which can fabricate fake nude images and videos using the likenesses of real individuals without their explicit consent.

The legislation also empowers victims to pursue civil lawsuits against those who engage in such practices, allowing them to seek financial compensation for damages incurred. Companies that are found to be in violation of this law could face severe penalties, with fines reaching up to $500,000 for each instance of unlawful use. While the law does include some limited exceptions for artistic and technical purposes, xAI's lawsuit, filed in the U.S. District Court for Minnesota, contends that the company already has strict policies in place that prohibit users from creating non-consensual nude deepfakes using its platforms, Grok and Grok Imagine. The company argues that the new legislation is overly broad and poses a threat to protected forms of expression, warning that if the law is enacted, it may be forced to restrict certain services for users located in Minnesota.
