Bombay High Court Provides Interim Relief to Developer in Defamation Case

In a significant ruling, the Bombay High Court has granted interim relief to SD Corporation Pvt Ltd, a developer based in Kandivali, in a defamation lawsuit against activist and politician Devang Dave, along with his associates Amit Kawle and Vishnu Bhosale. The court's decision, delivered by Justice Abhay Ahuja on July 27, came in response to allegations that the defendants had engaged in a campaign to defame the developer and undermine its ongoing redevelopment project. The court directed that any allegedly defamatory content, including social media posts, videos, and messages targeting SD Corporation and its MHADA redevelopment initiative, should not be disseminated further. This ruling underscores the court's recognition of the prima facie case presented by the developer, which seeks to protect its reputation and business interests from what it describes as malicious attacks.

The defamation suit, which amounts to a claim of 100 crore rupees, accuses Dave, Kawle, and Bhosale of spreading false and misleading information across various social media platforms, including Facebook, Instagram, and WhatsApp. SD Corporation alleges that the defendants' posts accused the company and the Maharashtra Housing and Area Development Authority (MHADA) of engaging in corrupt practices and fraud, while also calling for a boycott of the Sarova project. The developer contends that Dave, who claims affiliation with the Bharatiya Janata Party (BJP), has been inciting local residents against the company for the past three years, allegedly with ulterior motives. The developer further claims that Dave has a history of questionable behavior, including accusations of extortion while posing as a political aide, which led to a government investigation into his actions.

In a notable incident on May 19, despite lacking police permission, Dave reportedly led a protest of around 150 individuals aimed at disrupting the developer's sales efforts, further exacerbating the situation. The redevelopment project in question spans 55 acres and includes 166 buildings from 74 cooperative housing societies, with approximately 2,900 tenants, over 2,000 of whom have already been rehabilitated. Senior Advocate Chetan Kapadia, representing SD Corporation, argued that the defendants continued to publish defamatory content even after a cease-and-desist notice was issued on May 13. The defense, however, countered that the statements made by Dave reflected the grievances of several housing societies. Yet, when pressed by the court, it was revealed that Dave had no direct involvement with the redevelopment project. The court's observation that terms like 'corrupt' and 'fraud' used in the contested posts were likely to harm the developer's business led to the issuance of an order prohibiting the defendants from publishing any further defamatory material. This ruling is anticipated to set a precedent in addressing the challenges posed by individuals who disrupt development projects under the guise of activism, thereby reinforcing the legal protections available to developers against such actions.
