New York Implements New Age Verification Rules for Social Media Platforms

In a significant move aimed at enhancing the safety of children on social media, New York has introduced stringent age verification regulations. Announced by Attorney General Letitia James, these rules are part of the SAFE for Kids Act, which outlines how social media companies must verify the ages of their users. This initiative comes amid a broader global effort to hold big tech accountable for the protection of minors online. The regulations specify that users seeking access to algorithm-driven content and notifications during the late-night hours of 12 AM to 6 AM will need to have their ages confirmed by the respective platforms. Furthermore, any major tech company that features user-generated content and where users spend a minimum of 20% of their time on algorithmic feeds will be required to implement a more precise age verification method. While the guidelines provide various acceptable approaches and performance standards, they do not prescribe a singular method for age verification.

According to a report from The Verge, one potential method for age verification could involve the use of government-issued identification. Importantly, the regulations stipulate that any data collected for age verification must be deleted immediately after its purpose has been fulfilled. Additionally, minors are required to give their consent before any parental approval is sought, allowing parents to either grant or deny access to certain restricted features on social media platforms. This new legislation is set to take effect on January 25, 2027, and non-compliance could result in hefty fines for social media companies, potentially reaching up to $5,000 for each violation. The rules also mandate that platforms conduct annual assessments of their age verification systems and maintain records of these evaluations.
